Terms of Service

These Terms of Service (these “Terms”) have been established by Animi (hereinafter referred to as “Service”). By engaging in or using this service, you will be deemed to be a “User” who is legally bound by these Terms.

Definition

These Terms of service use the following terms:

1. “Posted content” means any data that is uploaded by a user to this service.
2. “Commission” means posted content that is created by a seller and sold to a purchaser.
3. “Seller” means the user who sold the commission.
4. “Purchaser” means the user who purchased the commission.
5. “Terms and Policies” means all documents created and posted directly by Animi under the names of “Terms”, “Policy”, “Notation”, and “Guidelines” including these Terms of Use in this service.

Consent

1. Users may not use the Services without a valid and absolute consent to the Terms and Policies.
2. If the user is a minor, valid and absolute consent by a parent or guardian is required.
3. When a user uses this service for any business, the business cannot use this service unless they agree to the terms and policies.
4. By using this service, the user has been deemed to have given valid and absolute consent to the terms and policies.

Provision of this service

1. When using this service, the user must prepare the necessary personal computers, mobile phones, communication devices, operating system, communication means, power, etc. at the user’s expense and responsibility.
2. Animi can provide all or part of this service only to users who have met the age, identity verification, registration information, and other conditions that Animi deems necessary.
3. Animi may change all or part of the contents of this service or discontinue its provision at any time without notifying the users in advance if Animi deems it necessary.

Account

1. When registering information about the user to use the Service, the user must provide true, accurate, and complete information, and must always correct it so that it is up to date.
2. Users must strictly manage their accounts at their own risk so that they are not used illegally. Animi can consider all actions performed using the user’s account as the user’s own actions.
3. The user can delete the user’s account at any time.
4. If Animi finds that the user violated or may violate the terms and policies, Animi may take measures such as suspending, deleting, or changing the account without notifying the user in advance. We do not undertake any obligation to disclose the reasons for taking these measures.
5. Accounts that have been suspended or deleted will expire any associated untransferred sales.
6. All usage rights of the user in this service will be extinguished when the account is deleted for any reason. Even if the user accidentally deletes the account, the account cannot be restored.
7. The user's account belongs to the user exclusively. All usage rights of the user in this service cannot be transferred, lent or inherited to a third party.

Advertising display

Animi shall be able to place advertisements of Animi or a third party on any part of the Service.

Attribution and license of intellectual property rights

1. The copyright and all other rights of posted content belong to the user that posted it.
2. The copyright and all other rights of commission belong to the seller.
3. Animi shall be free of charge for the posted content to the extent necessary for providing, promoting, improving, maintaining, advertising and promoting Animi or this service. It shall be possible to use and modify it non-exclusively, and the user shall permit this.
4. Animi and the business operator individually authorized by Animi may omit part of the information or the display of the name when using the information of the posted content in the form specified in the preceding paragraph.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

1. Systematically retrieves data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
2. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
3. Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
4. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
5. Use any information obtained from the Site in order to harass, abuse, or harm another person.
6. Make improper use of our support services or submit false reports of abuse or misconduct.
7. Use the Site in a manner inconsistent with any applicable laws or regulations.
8. Engage in unauthorized framing of or linking to the Site.
9. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Service.
10. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
11. Delete the copyright or other proprietary rights notice from any Content.
12. Attempt to impersonate another user or person or use the username of another user.
13. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
14. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.
15. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Service to you.
16. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
17. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
18. Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
19. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
20. Use a buying agent or purchasing agent to make purchases on the Site.
21. Make any unauthorized use of the Service, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
22. Use the Service as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.

Hiding and deleting posted content

Animi shall be able to take measures such as hiding or deleting posted content in the following cases, and shall not be obliged to disclose the reason for taking these measures.

1. When Animi determines that the posted content may violate the terms of service set by the settlement agency, delivery company, or other operating company or consignment company.
2. When Animi determines that the posted content infringes the interests of the right holder of a third party.
3. When a third party makes a claim to Animi, Animi determines that the claim is valid.
4. Violation of public order and morals or a third party from public institutions, reliability confirmation organizations, Internet hotlines, lawyers, etc. stipulated in the guidelines of the Act on Limitation of Liability for Damages of Specified Telecommunications Service Providers and Disclosure of Caller Information When it is pointed out that it infringes the rights of a person
5. In addition, if Animi determines that it is inappropriate in the operation of this Service regardless of whether it violates the terms and policies.

User Responsibility

We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated in accordance with the Site Privacy Policy. When you create or make available any Contributions, you thereby represent and warrant that:

1. The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
2. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.
3. You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.
4. Your Contributions are not false, inaccurate, or misleading.
5. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
6. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
7. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
8. Your Contributions do not violate any applicable law, regulation, or rule.
9. Your Contributions do not violate the privacy or publicity rights of any third party.
10. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
11. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
12. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.
13. If the operating company finds that the user is using this service in violation of this agreement, the operating company will take measures that the operating company deems necessary and appropriate. However, the operating company has no obligation to prevent or correct such violations.
14. The seller shall take all responsibility for the work and respect the laws and regulations.

Any use of the Site or the Services in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and the Service.

Disclaimer of Animi

1. Animi makes no warranties, express or implied, that the Services are virtually or legally free of defects. Animi is not obligated to remove such defects and provide this service to the user.
2. Animi does not take any responsibility for any damage caused to the user due to this service.
3. Animi will not be liable for any damages caused by special circumstances such as natural disasters or accidents among the damages caused to the user due to default or illegal acts due to the negligence of Animi.

Privacy

Animi shall handle the personal information of users appropriately based on the privacy policy.

Governing law and court of jurisdiction

The governing law of these Terms of Use shall be American law, and the Boston District Court shall be an exclusive jurisdictional court of the first instance if a proceeding is required between Animi and the user.

Revision

Animi shall be able to revise the Terms of Use without obtaining the consent of the users by appropriately informing the user in advance.
